Violate our content guidelines by:

  • Refrain from duplicating, rebranding, licensing, sublicensing, transmitting, broadcasting, displaying, or selling any information (excluding user-generated content submitted by you) sourced from UpFirms.
  • You are prohibited from utilizing, sharing, repurposing, redistributing, copying, or adapting any content, data, or information obtained from UpFirms to offer any service that competes, at our discretion, with UpFirms.
  • Alter or delete any copyrighted or trademarked material visible on the platform.
  • Offering or accepting payment in exchange for writing or deleting reviews or other user-generated content is strictly prohibited, except for incentivized reviews that adhere to our guidelines.
  • Submitting reviews for products or services provided by your current employer, as well as those offered by direct competitors or any other offerings that pose a conflict of interest, is not allowed.
  • When completing our 'personalized shortlist' form, it's essential to provide precise and relevant information. Accuracy enables us to connect you with the most suitable vendor for your project. Rest assured, the email address, phone number, and any additional details you provide will remain confidential and will not be disclosed to the service vendors.

Violate our Security Guidelines by:

  • Retrieve, duplicate, gather, employ, or transfer any data, encompassing personal user information sourced from UpFirms, except as expressly authorized in the terms of service or by UpFirms.
  • Seeking to bypass or disrupt Upfirm's foundational security measures or engaging in activities that directly or indirectly disrupt the functionality of our infrastructure.
  • Utilizing software, devices, robots, scripts, or any other method to extract, traverse, or catalog any webpage or section of our platform.
  • Participating in actions that mimic, imitate, or attempt to impersonate the likeness or functionality of UpFirms or any of its offerings.
  • Trying to gain unauthorized entry into UpFirms' services, user accounts, stored data, or systems through hacking or similar methods.
  • When completing our 'personalized shortlist' form, please ensure the information you provide is precise and pertinent. Providing accurate details enables us to align you with the most suitable vendor for your project. Rest assured, the email address, phone number, and any other miscellaneous information you supply will not be disclosed to the service vendors.

Engage in activities that cause harm, intimidation, harassment, or offense to others, or use an alias that conceals your true identity when logging in.

Acquire, store, capture, manipulate, transfer, or disseminate data belonging to other users.

Sponsorships and Incentivised Reviews

Obtaining a sponsorship on our platform enhances your brand's visibility and expands outreach. Sponsored companies feature prominently at the top of directory pages, identified by a "sponsored" label. It's important to note that sponsorship does not influence your ranking or placement on our Leader's Matrix, nor does it assure any specific level of traffic, leads, or sales. Sponsorships solely impact your positioning within our company listings.

Intellectual Property Rights, Ownership and Copyright Policy

UpFirms holds ownership of all content on our website, including services, graphics, designs, reviews, and user content compilations. While users retain ownership of their submitted content, they grant UpFirms the right to distribute, display, and advertise it as deemed appropriate. Our services are safeguarded by copyright and trademark laws in the United States and other countries. UpFirms exclusively owns all intellectual property rights to its services, and users are prohibited from altering, obscuring, or removing any trademark, copyright, or proprietary rights notices. Purchase Terms

All purchases made on our storefront, including sponsorship or start-up plans, are treated as subscriptions. The terms of your agreement with us, related to the subscribed product, remain in effect for the chosen subscription duration. Upon purchasing any of our services, you agree to pay the agreed-upon fee and any applicable taxes promptly as specified in the purchase agreement. Failure to meet payment deadlines may result in service termination. Payment methods accepted include credit/debit cards, bank transfers, or ACH-enabled bank accounts issued by recognized financial institutions. By subscribing to our services, you consent to recurring subscription fees charged by us or our payment agents, as outlined in the invoice, including all associated fees, charges, and taxes. Additional charges may apply if you choose to upgrade your subscription, and you are responsible for paying these fees on a pro-rata basis until the next billing cycle. Upgrades or downgrades will take effect in the subsequent billing cycle, with adjustments made to the subscription and pricing accordingly. Subscription changes will continue to be billed according to the original schedule but at the updated price after the nearest billing cycle.

Subscriptions are set to auto-renew on a monthly billing cycle. To cancel your subscription, please send a non-renewal or cancellation request to (support@upfirms.co ) at least five business days before your next billing date to ensure timely processing.

If your payment provider fails to process your payment or reaches its expiration, you are responsible for any unpaid amounts. Failure to update your payment information or cancel your subscription authorizes us to bill your existing payment provider and terminate your subscription.

Your responsibility to pay our fees persists throughout your subscription period or until you decide to cancel. Taxes are determined based on the payment details you provide during purchase. You have the option to suspend or terminate your subscription by reaching out to support@upfirms.co at any time.

Upon purchasing our services, you acknowledge that MyFirm reserves the right to cancel, terminate, suspend, or restrict your access to our services without prior notice or liability, with or without cause, including non-payment of fees. Additionally, we reserve the right to modify, upgrade, add to, or reduce the quality, availability, and nature of our services or products at any time, for any reason, including compliance with regulations or laws, at our sole discretion, without prior notice. We also retain the right to test, modify, or discontinue any products or services we offer, which may impact how customers access and pay for our services.

We do not provide any guarantees regarding the outcome of using our product or service offerings. You agree to take responsibility for the payments due under this agreement, regardless of any changes, modifications, or advancements made to MyFirm's services or products during the term.

General

These terms and conditions are governed by the laws of Las Vegas, Nevada, USA, and apply to your use of UpFirms irrespective of your country of residence, access location, or nationality. Any disputes arising from or relating to these terms must be exclusively resolved by state or federal courts situated in Nevada, unless otherwise agreed by the parties involved.

These terms, in conjunction with our privacy policy, constitute the entire agreement between you and UpFirms, superseding any prior or contemporaneous proposals or communications, whether written or oral, that may conflict with or augment these present terms.

Our failure to enforce any provision of these user terms does not waive our right to enforce such provision or any subsequent similar or different breaches. If any of these terms are deemed invalid or unenforceable under applicable law, the remaining terms remain in effect and do not affect the validity or enforceability of the remaining terms in these terms and conditions.
